AS-BUILT PERMIT APPLICATIONS
WHAT IS AN AS-BUILT PERMIT APPLICATION?
A as-built permit application is the set of graphic, technical, and legal documents aimed at regularizing an existing construction that has been executed or modified without the corresponding building permit.
In this type of project, the architect documents and certifies the work already carried out so that it can be registered in the Land Registry, brought into compliance with current regulations, and, in the case of dwellings, obtain the certificate of habitability.
Our office takes care of both the preparation of all the required documentation and its processing with the authorities.
GENERAL PROCESS
1.FEASIBILITY STUDY
Study where it is verified that the existing construction is compatible with the legal and urban conditions of the site. In ambiguous situations it will be necessary to make a direct consultation with the municipal technical services.
2.BUILDING SURVEY
To document graphically the current state of the construction
3.LEGALIZATION PROJECT
Technical project certified by the Catalan Architects’ Association, which validates the compliance of the completed construction work.
4. MUNICIPAL LICENSING PROCESS
After the project is submitted, the City Council will issue the permit and inspect the construction subject to legalization.
5.REGISTRATION OF THE LEGALIZED CONSTRUCTION
Once legalized, the construction will be registered in the Cadastre (Land Registry). Where applicable, the property deeds will also be modified and the certificate of occupancy/habitability will be updated for housing units.

If it is necessary to modify the existing building in order to comply with current regulations, an architectural project for renovation or rehabilitation must be prepared.
HORIZONTAL PROPERTY DIVISION
WHAT IS AN HORIZONTAL PROPERTY DIVISION?
A horizontal property division project is the set of graphic, technical, and legal documents that legally justify the act of dividing an existing real estate property (such as a building) into new independent and autonomous units, each of which becomes an individual registered property with its own description, surface area, uses, and ownership.
GENERAL PROCESS
1.FEASIBILITY STUDY
Study where the viability of the horizontal division is verified according to the urban planning conditions and the number of existing homes on the property.
2.BUILDING SURVEY
To document graphically the current state of the property.
3.HORIZONTAL PROPERTY DIVISION PROJECT
Document defining the division of the property into different units and the corresponding surface area calculations.
4.PROFORMA DEED
Based on horizontal property division project , the notary will draft the proforma deed describing the horizontal property division as it will appear in the final deed.
5. OBTAINING THE MUNICIPAL LICENSE
In most cases, three documents are required: the project, the proforma deed, and the certificate of encumbrances.
6. REGISTRATION OF THE HORIZONTAL DIVISION
Once the license has been obtained, the modification of the property will be registered in the Cadastre (Land Registry), certificate of habitability will be issued in the case of dwellings, and the property deeds will be updated accordingly.
HORIZONTAL DIVISIONS REQUIRING CONSTRUCTION WORKS
If carrying out the horizontal division requires modifying the existing construction, it will be necessary to prepare an architectural renovation or rehabilitation project describing the modifications to be carried out.
